Kerala HC intervenes in Nivin Pauly and producer Shamnas dispute; Mediation on Feb 20
The Kerala High Court has mandated mediation for disputes involving actor Nivin Pauly, producer P.S. Shamnas, and director Abrid Shine. The court also directed police to refrain from coercive action against Shamnas pending mediation. The long-running conflict between actor Nivin Pauly and producer P.S. Shamnas has taken a new legal turn with the Kerala High Court directing that both related cases be settled through mediation.Reports from the Reporter website says that the court also instructed the Palarivattom Police not to take harsh or coercive action against Shamnas based on the complaint filed by the ‘Sarvam Maya’ actor.The High Court also brought a second dispute—between director Abrid Shine and Shamnaz—under the same mediation process. The court has handed over the responsibility to its Mediation Centre which has been tasked with initiating and monitoring discussions between the involved parties.

Senior advocate appointed as mediator

To facilitate fair dialogue the High Court appointed senior advocate George Merlo Pallath as the official mediator. Reportedly the mediation session involving Nivin Pauly and P.S. Shamnaz has been scheduled for the 20th of this month. The High Court once again instructed the Palarivattom Police not to pursue extreme steps against Shamnaz until the mediation process is completed. These directives were issued in response to the petition filed by Shamnaz who had approached the court seeking protection from what he described as overreach by law enforcement.

Serious allegations and counter-allegations

The dispute traces back to a complaint filed by Nivin Pauly where he alleged that Shamnas had forged his signature to acquire the title rights of the upcoming film ‘Action Hero Biju 2’.On the other side, based on a complaint from Shamnaz, the Thalayolaparambu Police earlier registered a cheating case against Nivin Pauly. The producer claimed that the makers received money from him but later transferred the distribution rights of ‘Action Hero Biju 2’ to another party without informing him.

Claims linked to ‘Mahaveeryar’ and financial transactions

Shamnas had previously co-produced the film ‘Mahaveeryar’ which is directed by Abrid Shine and starring Nivin Pauly in the lead along with Asif Ali and Lal. His complaint alleged that the filmmakers concealed financial transactions from him. According to the FIR the makers took Rs 1.95 crore from him and later sold overseas distribution rights to another distributor for Rs 5 crore.The FIR further mentioned that Nivin Pauly’s company Pauly Junior received an advance payment of Rs 2 crore in connection with the deal. Shamnas claimed a personal financial loss of Rs 1.90 crore due to these actions.

Earlier court ruling provided relief to Nivin Pauly

The Judicial First Class Magistrate Court-I at Vaikom had earlier this year ordered that a criminal complaint be filed against producer Shamnas.Reportedly Judge Archana K. Babu concluded that Shamnaz had hidden facts and made wrong claims under oath.
