Months ago, reports revealed that Dua Lipa is suing a tech giant for using her images on their TV boxes. However, according to recent reports, the company has said that the singer cannot sue them over the alleged issue. They have also requested that the lawsuit be dismissed.
Tech giant files appeal to dismiss Dua Lipa’s USD 15 million lawsuit
Billboard revealed that the tech giant filed an appeal in court on September 10 to request that the judge overseeing the case dismiss it directly. According to the outlet, the company is stating that Lipa cannot sue them for her photograph being used. As per the outlet, their legal team shared, “Defendants respectfully request that the court dismiss the complaint in its entirety,” further adding, “An interface depicting a music-video channel among several unrelated content icons conveys nothing suggesting the plaintiff endorses the televisions. The images merely depict the televisions’ on-screen interface, illustrating the applications and … an example of content available on the TV.”According to the company’s lawyers, Lipa has no trademark rights to her likeness, which is why she cannot rightfully sue them for her images being used on the TV boxes. They further stated that her face alone is not on the box and appears alongside a lot of other logos. According to their statement, they are also placing the blame on the content provider they used, which assured them that the content could be used without any issues with copyright and trademark infringement.The statement further added, “The image was used only after receiving explicit assurance from the content partner that permission had been secured, including for the retail boxes. Given this assurance, we deny any allegations of intentional misuse.”They concluded, “The complaint’s right of publicity causes of action fail to state a claim because … English law must apply, and England does not recognize a right of publicity.”
Dua Lipa’s lawyers respond to the filing and the tech giant’s lawyers’ statements
The singer’s lawyers also issued their own statement into the matter, adding, “Samsung’s response has been dismissive and callous, and the infringing products remain on the market to this day.” Samsung’s infringing conduct—using Ms. Lipa’s assets for zero consideration—makes a mockery of her hard work.”“Ms. Lipa’s face was prominently used for a mass marketing campaign for a consumer product without her knowledge, without consideration, and as to which she had no say, control, or input whatsoever,” the lawyers previously said in the lawsuit. “Ms. Lipa did not allow and would not have allowed this use,” they further shared.As of right now, there have been no other updates about whether the case is going to be dismissed or if it will hold up in court and will go to trial.On the personal front, Dua Lipa recently got married to her longtime partner, Callum Turner, in an intimate courtroom wedding.
