US national gets default bail in terror case

NEW DELHI: A special NIA court in Delhi Friday granted default bail to the US national arrested in March on terror charges for allegedly helping ethnic armed groups in India and Myanmar, days after the “incomplete” chargesheet filed by the investigating agency dropped charges under UAPA, reports Koushiki Saha.While granting bail to Matthew Aaron VanDyke, who has spent 180 days in custody, the court noted NIA’s failure to complete its probe. It cannot be concluded that the accused is not entitled to default bail merely because an agency says a probe is far from over, the court said.VanDyke had sought default bail Thursday, contending that under Section 43D(2) proviso (1) of the anti-terror law, the investigation was required to be completed within 180 days, which ended on Sept 8.
