Page Six officially reported that the 60-year-old has been granted primary custody of his and Berry’s son, Maceo. The news comes after he filed for a temporary restraining order, which the court also granted, according to the outlet. Since their split, the couple shared 50/50 custody of their son, which she has now lost according to the restraining order.The actress will only be able to meet Maceo during court-ordered visitation, scheduled for two days a week and every other weekend. Additionally, the restraining order requires Berry to stay within 100 yards of Martinez. The next court hearing for their case has been set for October 16.
Halle Berry’s legal aid denies all allegations
In a statement provided to the outlet by Marina Beck, she denied all allegations the French actor claimed against Berry. Her statement read, “There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son Maceo—misconduct for which Mr. Martinez has already been legally sanctioned.”Along with this, the statement also accused Martinez of “erratic, possessive, and violent behaviour.” The statement then concluded: “Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs.”

According to reports shared online by TMZ, Martinez alleged that a recent altercation took place between Berry and their son, Maceo, on September 26 over a video game. The filing, which was filed on October 1, revealed that the actress had allegedly called Maceo “so stupid” and “such an idiot” while he was playing video games. Official statements from the filing also added that she caused him “emotional and mental distress due to physical abuse of our minor child, Maceo” and that she “physically abused our son, Maceo, by jumping on him, putting her hands around his neck, and choking him.”The filing further alleged that this was not the first instance of abuse. “While the September 26, 2026, incident in which Petitioner choked our son is the latest incident of abuse, I contend that there have been other instances of abuse over the course of the last few years. These other incidents involve additional physical attacks against our son, as well as verbal and emotional abuse from Petitioner to me,” the statement added.He also shared that Berry shared multiple texts with him about their son and how he had ‘disrespected’ her. One of the alleged texts from the actress read: “‘He is disrespectful to me and feels I have no say on anything. I’m just moneybags! This is wrong and wrong!’” At the time, the French actor revealed that he had also asked Berry if he needed to pick Maceo up, to which she had replied by saying that everything was fine.Halle Berry and Olivier Martinez met in 2010 on the set of the thriller film ‘Dark Tide.’ They started dating soon after and announced their engagement in March 2012.
